Why Driver Monitoring (DMS) Will Soon Become Mandatory in Vehicles Around the World
Driver Monitoring (DMS) and the new legislations explained
Imagine if the invention of the car came with a warning sign. The words “will eventually be responsible for the death of 1.24 million people a year” would likely cause it to be dismissed as too dangerous to use, and maybe a horse-drawn carriage would still be a common mean of transportation. But in reality, the dangers of driving is something that has become increasingly apparent as the number of cars in the world has skyrocketed – now believed to surpass a billion. And while automakers keep finding innovative ways to make their cars safer, one important aspect of driving remains unchanged since the launch of the very first car: the driver. We have yet to find a way to program away driver drowsiness or inattention – both leading causes behind fatal car accidents. However, Smart Eye has found a way to avoid letting these common human errors cause deadly crashes.
For now, the solution is not as simple as removing the driver from the equation. While the idea of autonomous driving is captivating, most experts agree that safe, fully self-driving cars are quite a few years away. Meanwhile, as human-operated cars keep increasing around the world, legislators are beginning to understand the importance of driver monitoring in order to prevent heavily trafficked roads from becoming death traps. The European Union and China are well on their way towards making driver monitoring systems mandatory in all new vehicles, and the United States is preparing for a trillion-dollar investment in all-around safer roads. From the looks of it, the next decade could bring us closer to eliminating the dangers of driving than ever before.
The EU
In Europe, the consequences of distracted driving have left significant mark. Out of 35 000 fatal car accidents each year, almost 40 per cent can be attributed to an inattentive driver. But the European Union has recently taken important steps toward decreasing road crashes.
In November 2019, the EU Council of Ministers passed a general safety regulation mandating automakers to install advanced safety systems in all new cars on the EU market. These advanced safety systems include camera-based driver monitoring to detect inattention or drowsiness in the driver, and to issue a warning if driver distraction is identified. The new regulations will be gradually implemented over the course of four years, starting in 2022 with all new type-approved cars with a certain level of autonomous driving capability. By 2026, the law will include all newly produced cars on the EU market, no matter their level of automation. With the new regulation in place, it is believed at least 140,000 serious injuries will be have been avoided by 2038.
While legislation is a slow process, Euro NCAP has taken a quicker, but effective, path in their work to improve traffic safety. In the next update of Euro NCAP’s safety measuring systems, driver monitoring will be included as one of the primary safety features required for any car model looking to receive the sought-after five-star safety rating – setting the standard for all OEMs operating on the European market.

China
One of the most dramatic examples of how quickly the number of cars in the world is increasing can be found in China. In 2018 alone, 4.3 million buses and trucks were sold – making up just a small portion of the vehicles introduced on Chinese roads every year.
In order to keep up with these rapid developments, regulations mandating the installation of driver monitoring technology in vehicles are under way – in select provinces as well as on a national level. Back in 2018, Jiangsu was the first province to implement regulations requiring long distance trucks and vehicles transporting hazardous goods to use driver monitoring, and a national notice is anticipated in 2020. But these regulations are only to be seen as a first step, as notices including other types of vehicles are expected to follow.
The United States
The United States is one of the world’s busiest countries in terms of road traffic, and consequently suffers more road crash casualties than any other high-income country. According to the National Highway Traffic Safety Administration (NHTSA), over 35,000 people are killed in crashes on U.S. roads every year.
However, an important step towards decreasing these numbers was taken on July 1st, 2020, when the U.S. House of Representatives passed the Moving Forward Act – a 1.5 trillion-dollar infrastructure bill committed to making roads safer. One of the safety measures included in the bill is to make installation of technology that detects inattentive or intoxicated driving required in newly produced vehicles. However, before the Moving Forward Act can become a law, it needs to pass the senate as well as be signed by the President.
Another bill investigating how the use of driver monitoring systems can improve road safety is the “Stay Aware For Everyone” (SAFE) Act of 2020, which is part of a broader surface transportation reauthorization legislation. Just like the Moving Forward Act, the SAFE Act proposes for the U.S. Department of Transportation to conduct research into how driver monitoring systems could minimize driver distraction associated with an increased reliance on advanced driver-assistance systems. This could in turn lead to regulations that require driver monitoring technology to be installed in all new vehicles. Should this current version of the SAFE Act pass, automotive manufacturers would be mandated to adapt to the new legislation within four to six years.
Smart Eye’s role in a new automotive market
As devoted advocates for safer roads, Smart Eye are the first to welcome regulations that are expected to decrease accidents caused by driver distraction. But for us, these types of regulations signify security in a double sense of the word. Regulations that make driver monitoring systems a given in new cars are highly-effective measures that, apart from making our roads safer, also offers a sense stability for Smart Eye as a leader of innovation in the automotive industry – even in times as uncertain as these.
With driver monitoring as a standard feature in all new car models, Smart Eye has the opportunity to further establish ourselves on the automotive market. Let’s say an OEM is currently installing eye tracking technology into, for example, 10 percent of their new car models. Regulations mandating driver monitoring in all new vehicles will quickly bump that number up to 100 percent. And with millions of vehicles being produced each year, this makes quite a difference for Smart Eye’s position in the automotive industry.
We cannot, nor would we want to, turn back the clock and stop cars from becoming part of our everyday lives. But we can break the developments that point towards road traffic injuries becoming the fifth leading cause of death worldwide by 2030. And in order to succeed, legislation and regulations are among our most powerful tools.

Approved by the Full House – Moving Forward Act
On July 1, the House of Representatives in USA passed its signature infrastructure legislation, the Moving Forward Act. The below is mentioned about DMS.
‘‘(A) Driver monitoring systems that will minimize driver disengagement, prevent automation complacency, and account for foreseeable misuse of the automation…”
“(B) After completion of the research required under subparagraph (A), the Secretary shall include each of the safety systems in the crash avoidance rating not later than 3 years after the date of enactment of this section..”

In Europe alone there are over one million car accidents every year and 35 000 of them result in casualties. Almost 40 percent of these are a result of a lack of attention from the driver. This means that they could have been avoided with a driver monitoring systems (DMS) implemented.
With the new regulations from EURO NCAP, and the passing of the EU road safety regulation Smart Eye will finally be able to implement our technology in the automotive industry on a much larger scale.
The automotive industry is very demanding, as it should be. Thankfully Smart Eye has already proven its ability to create durable, accurate and reliable technology for years now. And its capability to provide it in a cost-efficient way. We have always encouraged progressive and advanced safety systems and look to this development as a milestone in driver safety.
A new era of automotive safety
In 2019, EU decided on new legislation stating that starting in June 2022 all new cars put on the EU market, must be equipped with advanced safety systems. This includes, among others, driver drowsiness and attention warning, as well as advanced driver distraction warning. Meanwhile, similar regulations are being adapted in China.
In addition, EURO NCAP is adjusting their safety measuring systems where driver monitoring is required in order to receive a five-star rating. Euro NCAP is an effective and fast working way to reduce car related injuries and casualties on the roads of Europe. While legislation both nationally and in the European union can take years; Euro NCAP sets its own demands and creates incentives for OEMs to integrate safety systems without the presence of a law.
Previously, the industry has seen other ways in supporting driver attention, however a camera has been proven to provide the highest standard of accuracy. In order to meet these new demands from both the European Union and EURO NCAP a camera is required. In this field Smart Eye is world leading.
Smart Eye is NCAP ready
The specific technological requirements to meet these new safety regulations is still being developed. EURO NCAP tests new cars through different systems adapted for the safety features needed to reach the highest rating. How these test systems are formed is what will ultimately tell us what technology is needed to fulfill the requirements. With Smart Eye as one of the companies involved in actually assisting EURO NCAP in that process – the testing systems will partially be built on our technology. The testing systems will hopefully be finalized by the end of the year 2020.
EURO NCAP is not the only car assessment program in the world but have equivalents in both China and the US. Just like in any other industry they look to each other. In other words, EURO NCAP might be first, but will most certainly not be the last to adjust their requirements to match the technological advancement in the industry. Having the opportunity to be a part of this important starting point is a task that Smart Eye meet with both excitement and a feeling of utmost privilege.
Smart Eye at the forefront of automotive safety
The automotive industry is sensitive to the state of the market. As the world might enter a time of possible economic hardships as a result of the corona virus, we understand that there might be some concern. However, in 2019 over 15 million cars were sold on the European market. The impact these new laws and regulations will have on the driver monitoring industry is, to say the least, substantial. Even in times of a complex economic climate. This was not only manifested on March 19, in the midst of the corona crisis, when Smart Eye received its largest automotive order yet, and from new car manufacturers.
These major developments within the European Union is what Smart Eye has been working towards for 20 years. This also means that Smart Eye has been preparing for this since the start of the millennia. We have always been encouraging and developing towards progressive automotive safety measures. By 2025 we hope to be able to point to mass-produced cars all over the world where Smart Eye’s technology is saving lives.

Smart Eye crowned by success, announces 24 new design wins with four different OEMs in one fell swoop
Of the four OEMs two are new customers; one is an American high-volume car maker and one is a European premium manufacturer, and two are existing European premium customers. The estimated combined life-time value of the four contracts is at least 500 MSEK.

This ensures the combination of optimized performance, competitive system cost and is qualified for safety critical automotive applications. The car platforms are all estimated to go into production in 2022 with a string of new cars being launched over the following years.
“It’s important to keep in mind that DMS is a safety system driven by EU legislation, regulations and organizations such as EuroNCAP. The automotive industry may face difficulties now, but the car drivers of the future will still be protected by intelligent safety systems that will reduce traffic accidents” according to Martin Krantz.
Through its leading position for DMS in the automotive industry, Smart Eye has already secured its sales for the coming years. This provides a solid base for the delivery of DMS in the short and medium-term.
“This constitutes a large part of the competitive procurement processes communicated during last year and we are poised for further victories in the near future. This is a solid foundation for the company, and we are determined to continue to lead the automotive DMS industry into the 2020s, as it’s becoming as common as seatbelts and airbags” says Martin Krantz.
As a precautionary measure with the current market volatility due to the coronavirus, Smart Eye has decided to lower its operating costs in order to conserve cash. The cost reduction program enters into effect immediately. Special emphasis is placed on ensuring that the numerous delivery commitments to the global automotive industry are met. This ensures the financial stability for operating the company for at least 18 months. The company retains readiness to quickly scale up if Corona related uncertainties improve.
Smart Eye has received a total of 81 design wins from 12 OEMs. The combined estimated lifetime value from current design wins is now larger than 2,000 MSEK.
The potential for securing more car models on the new platforms is at least another 2,000 MSEK.
